Application

It is beforehand specified that the General Conditions of Sale apply between « tout-mignon.com », an Internet site of Escale.jp Co., Ltd. (called Escale.jp) and any person carrying out a purchase on this site, called the « customer » or « buyer ».

The present Conditions of Use are permanently accessible through the website: « tout-mignon.com » and the customer can consult and print them at any time.

Escale.jp can change at any time the present Conditions of Use but the applicable conditions are those in force at the date of the order.

If the customer is under 18, he or she may use « tout-mignon.com » only with the involvement of a parent or guardian.

Order

By validating the order, the customer accepts the entirely of these Conditions of Use, the payment, the shipping and returns conditions.

To place an order, the customer has to click on the button « Add to cart ». After each added product, the customer gets a summary of all the articles he has selected before. At this moment, the buyer must verify the content of his order and change it if it is necessary. The customer has also the possibility of cancelling definitively the order.

When the buyer has finished, he clicks on the button « Check out ».

Escale.jp will send a summary of the order by e-mail.

The bill will be send with the parcel.

Products

Each product sold on the Internet site « tout-mignon.com » is guaranteed new (except the CDs which are used and of good quality) and issued from Japanese suppliers and / or manufacturers.

Each product has a description (material, colors, size, price) and is illustraded with pictures. These informations are displayed for illustrative purposes and are not contractually. Escale jp can not be liable if the picture or description can not represent exactly the product.

In order to obtain more information about the articles, the customer can contact Escale.jp by e-mail.

Prices and taxes

All prices are net, displayed in euros or in US dollars, except shipping costs.

Escale.jp reserves the right to modify its prices at any time but the products will be billed on the basis of tariff in force at the time that orders are made.

Any order could be subjected to possible customs duties and other local taxes. The buyer is entirely responsible of these taxes. Escale.jp can not predict anything about the customs policies. Anyway, low value or small packages are usually free of taxes. For more information, the customer can consult the appropriate local authorities.

Availability of the articles

The products are valid while they are displayed on the website « tout-mignon.com », subject to stock availability.

Shipping costs and delivery information

The shipping costs include a share in the expenses of preparation and packing.

S.A.L. is a service where international mail is handled as surface mail in both Japan and the destination country and as airmail between the two countries.

S.A.L. is available for various countries.

All deliveries are sent by registered airmail and insured up to 6000 yens. A package weighting more than 2 kgs cannot be shipped by this way and the size don’t exceed (all sides added) 90 centimetres.

The estimate delivery depends on the country; for Europe or North-America , the approximate time is 2 weeks, sometimes more.

Internet tracking is not available.

* By E.M.S. (Express Mail Service)

This delivery is available over 120 countries worlwide. This way of shipping is quick and safety.

The customer will receive the package in less than a week and, in case of damage or loss, the parcel will be insured (20000 yens). Depending on the destination country, the customer will be able to track the parcel through Internet. The tracking number will be provided by Escale.jp.

The package weight is automatically calculated according the customer’s order and the destination area.

Delivery and responsability

The delivery of the order takes place after the complete payment and it is carried out at the address given during the order.

Escale.jp could not be liable for:

• * any item damaged during the shipping ;
• * in the case of incorrect, incomplete or false address;
• * strikes;
• * force majeure (fires, floods, war, riot,catastrophes)
• * impossibility of being supplied by manufacturers and / or suppliers.

Payment and security

Payments are done in euros or US dollars.

The customer has two means of payment offering a maximum of guarantees of safety:

• * by credit card via Paypal (for more information click here). The Internet site « tout-mignon.com » is made safe by the system of encoding SSL (Secure Socket Layer). The Paypal payment is easy to use, fast and does not comprise additional expenses. The customer can pay without subscribing of Paypal account;
• * directly by the customer’s Paypal account.

Complaints and returns

The customer who received a wrong item or a product with manufacturer defect must contact Escale.jp by e-mail. The product must be returned in its packing of origin and in a deadline of seven days. After verification, Escale. jp will send the buyer the exchange item or will make a full refund. Damaged products or dirtied by the buyer are not acceptable.

Right of retractation

The customer has a seven days deadline frank as from the reception to turn over the products in its packing of origin. The expenses of sending and returns must be payed by the buyer (included the refunding commission) ; only the price of the articles will be refunded. Refunding is within 15 maximum day after the reception of the product. Damaged products or dirtied by the buyer are not acceptable.

Cancellation

Escale.jp reserves the right to cancel or refuse any order for which:

• * there is a fraudulent risk, real or assumed;
• * there would be a litigation relating to the payment of a former order;
• * a product can not be restock.

Privacy Notice

Escale.jp undertakes not to disclose to third parties any information which the buyer provides. All personal information will be treated as confidential and will be only used by Escale.jp for the treatment of the order and to improve the communication with the buyer, in particular by means of newsletters.

The buyer has a right of access, of correction and opposition to the personal data concerning him or her.

Applicable law

Contract informations are written in Japanese, French and English.

Escale.jp being a Japanese company, all the clauses appearing in these Conditions of Use are subjected to the Japanese law.

Escale.jp could not be committed in the case of non-compliance of the legislation of the country where the products are delivered.
